Welcome to CF5.am. These Terms of Use ("Terms", "Terms of Use") govern your relationship with www.cf5.am (the "Site") and the services provided by CF5.am ("we", "us", "our", or "CF5"), including website and mobile application design, development, and maintenance (the "Services").

Please read these Terms of Use carefully before using the Site and our Services. By accessing or using the Site and Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

Services Description

CF5 provides professional services in web and mobile development, design, maintenance, and consulting. Detailed descriptions of our services are available on the relevant sections of our Site. Any specific terms for a particular project will be outlined in a separate agreement between you and CF5.

Intellectual Property

• Site Content. The Site and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of CF5.am and its licensors. The Site is protected by copyright, trademark, and other laws of both Armenia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CF5.am.
• Project Deliverables. All custom code, designs, and other materials created by CF5 for a client ("Deliverables") are owned by CF5 until full payment for the project has been received. Upon receipt of full payment, ownership of the final Deliverables is transferred to the client, subject to the terms of the specific project agreement. CF5 retains the right to display the work in its portfolio.
• Client Materials. You retain all ownership rights to any content, data, or materials you provide to us ("Client Materials"). By providing Client Materials, you grant us a non-exclusive, royalty-free license to use, reproduce, and modify such materials solely for the purpose of providing the Services to you. You represent and warrant that your Client Materials do not infringe the rights of any third party.

User Accounts and Responsibilities

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

Limitation of Liability

To the maximum extent permitted by law, in no event shall CF5.am, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Our total liability to you for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you paid us, if any, during the twelve (12) months preceding the event giving rise to the liability.

Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

CF5.am, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the results of using the Service will meet your requirements.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Armenia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
